Shah
‘Abbas, the king of Iran, always enjoyed being in the company of the
learned people. Once he went on an outing with a group of Scholars which
also consisted of two great Mujtahideen of that time namely Shaykh Bahai
and Mir Damaad.
The horse
of Shaykh Bahai was trotting with pomp and elegance while the horse on
which Mir Damaad was riding moved slowly and with dignity. On seeing
this, Shah ‘Abbas decided to test the Scholars separately. He first came
to Mir Damaad and said, “Just look at Shaykh Bahai, how boastfully he
is riding!” Mir Damaad replied, “It is not the Shaykh but the
animal that is cognizant of the precious burden it is carrying and is
therefore trotting proudly”.

Sayyid Ali al-Husaini Seestani was born
in Rabi-ul-Awwal 1349 A.H. (1930 A.D.). He started his studies in
Mash'had, Iran, where he attended Dars-e-Kharij graduation classes.
In 1368 A.H. he moved to Qum for

In the previous discussion, "The
Principle of Ijtihad in Islam", two trends in Islamic thought were
referred to. One of them related to the subject of the justifiability or
unjustifiability of the use of qiyas and ijtihad bi al-ra'y, a practice
that acquired prevalence among different schools of fiqh. The other was
regarding the controversy about Divine justice and reason as the
criterion of moral and legal judgements (al-husn wal-qubh al-'aqliyyan)
among the mutakallimun. These controversies actually revolved around the
central issue of the role or the "rights" of reason.
